Terms of Service

MogGPT is sold as one-time purchases. There is no subscription and no recurring charge. Each purchase is charged once, at the price shown at checkout, and includes:

• Profile Rebrand: one profile scan with a full report, 24 tailored AI photos (3 photo concepts of 8 photos each, with up to 2 free rerolls per concept), and your first AI profile if you have not trained one yet
• Audit Only: one scan with a full report
• Upgrade to Profile Rebrand: 24 tailored AI photos for a completed scan, including your first AI profile if you have not trained one yet
• 3-more-concepts expansion: 3 additional photo concepts and 24 additional photos for a completed scan, limited to one purchase per scan
• Photo enhances add-on: 20 photo enhancements
• Extra AI profile: one additional trained AI profile

All payments are processed securely through Stripe. Purchased scans, photos, enhancements, and profile credits do not expire while your account remains open, but they are tied to your account and are not transferable.

Because each purchase triggers real AI processing costs on our side, all sales are final. Refunds are handled at our discretion through support. We reserve the right to change pricing at any time; changes never affect a purchase you have already made.

When uploading content to MogGPT, you must follow these rules:

• Upload only your own profile screenshots and photos, or content you have permission to use
• For AI photo generation and enhancement, upload only photos of yourself, no third-party faces
• Maximum file size of 10MB per image
• You must be 18 or older

By uploading content, you represent and warrant that you own the rights to it or have permission to use it, and that any photos used for AI generation or enhancement depict only you. You grant MogGPT a limited, non-exclusive license to process your uploaded content solely for the purpose of providing the Service. We do not use your uploaded content to train our own AI models or for any purpose beyond scoring your profile and generating your requested outputs.

Uploads are screened before processing. We reserve the right to reject or remove uploads that violate these rules, and to cancel associated audits or generations without refund.

MogGPT provides AI-generated feedback (Profile Scores, notes, and action plans) and AI-generated photos to help you optimize your profile. You acknowledge and agree that:

• Profile Scores and audit feedback are AI-generated opinions intended as suggestions, not professional advice or objective measures
• Generated and enhanced images are artificial and may not accurately represent your real appearance; AI outputs may be imperfect and should be used at your discretion
• Results vary based on input quality, selected styles, and AI processing
• MogGPT does not guarantee any specific outcome, quality level, or result
• MogGPT does not guarantee matches, dates, attractiveness, or any social or romantic outcomes from using the Service, your Profile Score, or any generated photos
• You are solely responsible for how you use AI-generated images and feedback, including on third-party platforms

Your uploads: You retain all rights to the photos you upload. MogGPT does not claim ownership of your uploaded content.

Generated outputs: You are granted a non-exclusive, worldwide, royalty-free license to use, download, and share the AI-generated images produced from your uploads for personal, non-commercial use. MogGPT does not claim ownership of generated outputs.

The Service: All other content, trademarks, logos, and intellectual property associated with MogGPT remain the property of MogGPT and its licensors. You may not copy, modify, or distribute any part of the Service without prior written consent.

You may not use MogGPT to:

• Generate images of other people without their consent or impersonate others
• Create illegal, harmful, harassing, defamatory, or obscene content
• Deceive or defraud others, including catfishing or identity fraud
• Circumvent, disable, or interfere with security features of the Service
• Use automated tools, bots, or scrapers to access the Service
• Reverse-engineer, decompile, or attempt to extract source code from the Service
• Resell, redistribute, or commercially exploit generated images without authorization

Violation of these rules may result in immediate account termination without refund.

MogGPT retains your data according to the following schedule:

• Profile screenshots & source photos: Automatically deleted within approximately 24 hours of upload
• Generated & enhanced outputs: Kept for at least 30 days after your most recent purchase; any new purchase extends the window. You can delete them manually anytime.
• Audit scores & reports: Retained as text only (no images) so you can track progress, until you delete the audit or your account
• Account data: Retained until you delete your account

You may manually delete your data at any time through your account dashboard. Deleting your account also removes your trained personal image models ("Souls"). Deleted data is permanently removed from our storage systems.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOGGPT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO MOGGPT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Before filing any formal claim, you agree to first contact us at legal@moggpt.com and give us 30 days to try to resolve the dispute informally. Most concerns can be resolved this way, including refunds where we determine they are appropriate.

IF WE CANNOT RESOLVE A DISPUTE INFORMALLY, YOU AND MOGGPT AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY A RECOGNIZED ARBITRATION PROVIDER UNDER ITS CONSUMER ARBITRATION RULES, RATHER THAN IN COURT, EXCEPT THAT EITHER PARTY MAY BRING AN INDIVIDUAL CLAIM IN SMALL CLAIMS COURT. THE FEDERAL ARBITRATION ACT GOVERNS THE INTERPRETATION AND ENFORCEMENT OF THIS PROVISION.

YOU AND MOGGPT EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY.

You may opt out of this arbitration agreement by emailing legal@moggpt.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out does not affect any other part of these Terms.
